TERMS OF USE OF THE STRATEGIOAPP SERVICE

1. General provisions

These Terms of Use define the rules for using the StrategioApp online service available at strategioapp.com (hereinafter: the “Service”).

The administrator and owner of the Service is:

The Service operates in accordance with Polish law and European Union law, in particular:

• the Act of 18 July 2002 on the provision of electronic services,

• Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

Using the Service constitutes acceptance of these Terms.

2. Definitions

User – any natural person using the Service.

Service – the StrategioApp online platform.

External Partner – a third-party entity offering travel or travel-related services (including airlines, booking platforms, hotel services, attraction operators, car rental companies).

Affiliate Link – a link leading to an External Partner’s service that enables identification of the referral source.

Content – information, summaries, comparisons, recommendations, price alerts, and other materials presented in the Service, including automatically generated content (e.g. by algorithms or AI tools).

AI Agent / Price Alert – a Service functionality involving automated monitoring of travel offers available in External Partners’ systems and providing Users with information, recommendations, or notifications (e.g. via e-mail) based on data entered by the User.

Notification – information sent to the User in connection with the operation of the AI Agent, in particular regarding price changes, availability, or recommended travel dates.

3. Nature of the Service and scope of services

StrategioApp is an informational and technological travel-tech platform.

The Service enables Users in particular to:

• search for and compare travel offers,

• analyze data originating from External Partners’ systems,

• use automated tools (including AI Agents),

• receive price alerts, recommendations, and travel-related notifications based on data provided by the User.

StrategioApp does not sell any goods or services.

4. No sales and no payment processing

The Administrator:

❌ does not sell flight tickets,
❌ does not sell accommodation or travel packages,
❌ does not process payments,
❌ does not issue invoices or receipts,
❌ does not conclude carriage contracts or package travel contracts.

All bookings, payments, and contracts are concluded directly between the User and the External Partner.

The Administrator is not a party to such contracts.

5. Affiliate disclosure

The Service uses affiliate programs (including the Travelpayouts platform).

Clicking an affiliate link may result in the Administrator receiving a commission.

The commission:

• does not affect the price,

• does not affect the terms of the offer available to the User.

The Administrator has no influence on:

• final prices,

• offer availability,

• booking, cancellation, or refund terms,

• complaint handling processes.

6. Data and content presented in the Service

Information presented in the Service is of an:

• informational,

• indicative,

• comparative nature.

Data originates from External Partners’ systems and may change in real time.

The Administrator does not guarantee:

• accuracy,

• completeness,

• availability of presented offers.

§6a. AI Agent and price alerts – limitation of liability

Notifications generated by the AI Agent are for informational and supportive purposes only.

The Administrator does not guarantee:

• availability of an offer at the moment of clicking,

• maintenance of the price indicated in the notification,

• successful booking under the conditions presented in the Service.

Prices, availability, and offer terms may change at any time, regardless of the AI Agent’s operation.

The decision to make a booking rests solely with the User.

The Administrator may limit the frequency of offer monitoring and notification delivery,
in particular for technical, organizational reasons, or due to the availability of data provided by External Partners.

7. No travel agency status

StrategioApp:

• is not a travel agency,

• is not a travel agent,

• is not a tour operator
  within the meaning of regulations on package travel and linked travel arrangements.

The Administrator is not responsible for the performance of travel services by External Partners.

8. Liability

Use of the Service is at the User’s own risk.

The Administrator is not liable for:

• decisions made based on the Service Content,

• damages resulting from actions of External Partners,

• price changes, delays, cancellations, overbooking, or other events attributable to service providers.

The Administrator’s liability is excluded to the fullest extent permitted by applicable law.

The operation of the AI Agent does not constitute:

• financial advice,

• investment advice,

• a guarantee of obtaining the lowest price.

The Administrator is not responsible for the consequences of decisions made based on automatically generated notifications or recommendations.

9. Complaints

Complaints regarding the technical functioning of the Service may be submitted to the Administrator’s e-mail address.

Complaints regarding bookings, payments, or service performance must be directed directly to the relevant External Partner.

10. Personal data (GDPR)

The controller of personal data is Alfaplus Sp. z o.o.

Personal data is processed in accordance with the Privacy Policy.

The Administrator does not process Users’ payment data.

The User may voluntarily consent to receiving marketing information (e.g. price alerts, offers), which may be withdrawn at any time.

The User may voluntarily subscribe to receive price alerts, notifications, or marketing information related to travel offers.

Notifications may be sent electronically (e.g. by e-mail).

Consent may be withdrawn at any time by:

• using the unsubscribe link included in the message,

• contacting the Administrator directly.

Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

11. Amendments to the Terms

The Administrator may amend these Terms for important legal, technical, or organizational reasons.

The current version of the Terms is always available in the Service.

12. Governing law

These Terms are governed by Polish law.

In matters not regulated herein, generally applicable laws shall apply.
